Partition Manager - End User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you (as either an individual or a single entity) and the vendor of the software product ("cutepm.com") for the use of the software product Cute Partition Manager (henceforth referred to as "Software"). The "Software" includes the computer software, online or electronic documentation, or any other associated materials. By downloading, installing or using the "Software", you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install or use the "Software".

GRANT OF LICENSE

You may install and use only one copy of the "Software" per license. This EULA requires that all the users of the "Software" be licensed, either individually, or as part of a group. The "Software" should either be licensed to a specified number of users, or as a Site License for a specified number of users at a single physical location, or as an Enterprise License for a specified number of users within a single organization.

COPYRIGHT

All title, trademarks and copyrights regarding the "Software" (including but not limited to any text, images, photographs, illustrations, animation, video, audio, and music incorporated into the "Software"), the accompanying materials, and any copies of the "Software" are owned by the software vendor. The "Software" is protected by copyright laws and international treaty provisions. Therefore, you must treat the "Software" like any other copyrighted material. Except as otherwise expressly provided, the software vendor grants no express or implied right under the patents, copyrights, trademarks or other intellectual property rights.

In short, the "Software" is licensed, not sold. Also, the "Software" can be freely distributed in its original form and you can make as many copies as you want.

RESTRICTIONS

You may not modify, rent, lease, lend, license, sell, enhance or pledge the "Software".
You may not disassemble, decompile or reverse-engineer the "Software".
You may not sublicense or permit simultaneous use of the "Software" by more than one user.
You many not adapt, create derivative works based on the "Software".
The "Software" is licensed as a single product, and its components may not be separated for use on more than one computer.
You may not remove or obscure the "Software" copyright and trademark notices.
You expressly agree to protect and take the necessary precautions against the unauthorized use, translation or decompilation of the "Software" and its associated materials.
You shall comply with all applicable laws (local and/or international), statutes, ordinances, treaties, codes of conduct and regulations regarding the use of the "Software".

WARRANTY

THE "SOFTWARE" IS PROVIDED "AS IS", WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. The software vendor does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the "Software".

LIABILITY

IN NO EVENT SHALL THE SOFTWARE VENDOR BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION OR LOST INFORMATION) RESULTING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE SOFTWARE VENDOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In short, the software vendor assumes no liability for damages, direct or consequential, which may result from the use of the "Software".

TERMINATION

The software vendor may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the "Software" and all associated materials.
